1. Acceptance of Terms
By accessing or using ChordApp.io (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, you may not access or use the Service.
2. Description of Service
ChordApp.io provides a management platform for flight syndicates, including flight logging, scheduling, financial tracking, and AI-driven weather analysis. The Service is intended for administrative and management purposes and does not replace official aviation logs or regulatory requirements.
3. User Accounts and Security
To access certain features of the Service, you must receive an invitation from a Group Administrator and create an account. You are responsible for maintaining the confidentiality of your account credentials.
Third-Party Authentication: If you use a third-party service (e.g., Google) to log in, you are also subject to that service provider's terms and privacy policies. You must ensure that your third-party account is secure. We are not responsible for unauthorised access resulting from a compromise of your third-party account.
4. User Responsibilities
- Accuracy of Data: You are solely responsible for the accuracy of all data you enter, including flight times, engine hours, and transaction details.
- Aviation Compliance: Use of this Service does not relieve you of your responsibility to maintain official, legally-compliant pilot and aircraft logs as required by your national aviation authority (e.g., CAA).
- Prohibited Conduct: You agree not to misuse the Service or assist anyone else in doing so. This includes attempting to gain unauthorised access to other accounts or syndicate data.
5. AI and Weather Data Disclaimer
Our Service provides weather insights and flight briefings generated by AI technology. These insights are provided for informational purposes only. You must always conduct your own pre-flight planning and consult official meteorological sources (e.g., Met Office, NOAA) before making any flight-related decisions. We are not liable for any decisions made based on AI-generated content.
6. Payments and Direct Debit
6.1 Payment Processing via GoCardless
Recurring payments for syndicate membership fees and related charges are processed via GoCardless Ltd, a regulated payment institution authorised by the Financial Conduct Authority. When you set up a payment method, you will be asked to authorise a Direct Debit mandate through GoCardless's secure payment pages. By completing this process, you authorise GoCardless to collect payments from your nominated bank account on our behalf.
Your use of GoCardless's payment services is also subject to GoCardless's Terms of Service and Privacy Policy.
6.2 The Direct Debit Guarantee
All payments collected via Direct Debit are covered by the Direct Debit Guarantee, which offers the following protections:
- This Guarantee is offered by all banks and building societies that accept instructions to pay Direct Debits.
- If there are any changes to the amount, date, or frequency of your Direct Debit, ChordApp.io will notify you at least 3 working days in advance of your account being debited, or as otherwise agreed.
- If you request it, ChordApp.io will refund any payment taken in error. A full and immediate refund of the amount paid is available from your bank or building society.
- If you receive a refund to which you are not entitled, you must pay it back when ChordApp.io asks you to.
- You can cancel a Direct Debit at any time by contacting your bank or building society. Written notice should also be given to us.
6.3 Advance Payment Notification
We will notify you of the amount and date of each payment collection no less than 3 working days before it is taken. Notifications will be sent to the email address registered with your account.
6.4 Cancellation and Failed Payments
You may cancel your Direct Debit mandate at any time by contacting your bank directly or by notifying us via our contact form. Please note that cancelling a mandate does not cancel any outstanding financial obligations to your syndicate. If a payment fails, we may attempt to re-collect via GoCardless and will notify you by email.
7. WhatsApp Notifications (Optional)
7.1 Opt-In
ChordApp.io offers an optional WhatsApp notification feature that allows you to receive booking confirmations, payment alerts, and group announcements via WhatsApp. This feature is entirely optional and must be explicitly enabled in your account settings. You may disable it at any time.
7.2 Third-Party Services
WhatsApp notifications are delivered via Twilio Inc., a third-party communications platform, using the WhatsApp Business API operated by Meta Platforms, Inc. By enabling this feature, you acknowledge that:
- Your phone number and the content of notifications sent to you will be transmitted via Twilio's infrastructure.
- Messages will be delivered through the WhatsApp platform, which is operated by Meta and subject to WhatsApp's Terms of Service and Meta's Privacy Policy.
- You are responsible for ensuring that your use of WhatsApp complies with Meta's terms and any applicable regulations in your jurisdiction.
7.3 Limitation
We are not responsible for delays, failures, or errors in the delivery of WhatsApp messages caused by Twilio, Meta, or your mobile network or device. For critical communications such as payment notifications, we recommend also retaining email notifications as a backup.
8. Intellectual Property
All content and technology associated with the Service, excluding user-generated data, are the property of ChordApp.io and are protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, and revocable licence to access and use ChordApp.io for managing your aircraft syndicate.
9. Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service itself. Group Administrators also have the right to remove members from their respective syndicates.
10. Limitation of Liability
To the maximum extent permitted by law, ChordApp.io shall not be liable for any indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service, including but not limited to financial loss or aviation-related incidents.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising from these Terms or the use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
